Terms of Service & End User License Agreement
Terms governing the Dungeons & Glory closed playtest, website, accounts, and related services.

These Terms of Service and End User License Agreement (the Terms) state the proposed rules for access to the Dungeons & Glory website, accounts, closed playtest, game client, and related services.
1. Operator and acceptance
Dungeons & Glory is developed, published, and operated by Trash Panda Software. These Terms and the Privacy Policy are available before account creation and from the game login screen. Creating an account requires an unchecked in-client confirmation that you are at least 18, agree to the current version of these Terms, and acknowledge the Privacy Policy. An existing account without a current acceptance record receives the same explicit gate after its password verifies and before gameplay can begin. Trash Panda Software records the accepted Terms version and the server-observed UTC acceptance time with the account. Visiting the website, downloading the game, or passive continued use alone is not claimed as acceptance. If you do not agree, do not accept or use the game or services.
You must be at least 18 years old and located in the United States. If you use the service for an organization, you represent that you have authority to bind it, but the license below remains limited to authorized individual users.
2. Closed-playtest license
Subject to these Terms, Trash Panda Software grants you a limited, personal, revocable, non-exclusive, non-sublicensable, and non-transferable license to install and use the available closed-playtest build for personal entertainment and testing. No ownership interest is transferred. The playtest is prerelease software: features, content, balance, compatibility, access requirements, data formats, and availability may change or be removed.
You may not copy, sell, rent, lease, sublicense, commercially exploit, distribute, publicly host, reverse engineer, decompile, or modify the game or services except where these Terms, applicable open-source licenses, or non-waivable law expressly permit it.
3. Accounts and credentials
You are responsible for activity through your account and for protecting its password. Accounts and credentials are personal and may not be sold, shared, licensed, or transferred. Notify support@dungeonsandglory.com promptly if you suspect unauthorized access. Trash Panda Software stores a per-account, randomly salted one-way password hash rather than your plaintext password. The stored credential is not reversible, so Trash Panda Software and support cannot retrieve or send your original password. The playtest has no automated password reset or email-based recovery, and support may be unable to restore access when control cannot be verified.
Usernames are public account identifiers. You may not choose a username that is unlawful, infringing, deceptive, impersonating, threatening, hateful, sexually exploitative, or abusive. Trash Panda Software may require a change or restrict an account using an inappropriate name.
4. Rules of conduct
You may not, directly or through another person or tool:
- cheat; exploit defects; use unauthorized automation, bots, macros, or modified clients; or manipulate progression, rewards, matchmaking, or server state;
- bypass access restrictions, rate limits, authentication, bans, security measures, or other technical controls;
- attack, overload, probe, disrupt, scrape, or gain unauthorized access to the game, website, accounts, networks, or other players' devices or data;
- harass, threaten, stalk, defraud, impersonate, or abuse another person, or facilitate hateful, sexually exploitative, or unlawful conduct;
- upload, transmit, or link malware, unlawful material, infringing material, secrets, or content you lack the right to provide;
- trade, sell, buy, transfer, or advertise accounts or virtual property for money or other value; or
- encourage, assist, or conceal a violation of these Terms.
Good-faith bug reports sent privately to support are welcome. Testing must not disrupt the service, access another person's information, or exceed the authorization we give you.
5. Virtual property and progression
Characters, usernames, equipment, items, currencies, unlocks, skills, statistics, progression, and other virtual records are features of the licensed service. They are not owned property, have no cash value, are non-transferable, and cannot be redeemed for money or anything outside the game. Server records control if a client display differs.
Because this is a closed playtest, Trash Panda Software may change, correct, rebalance, suspend, reset, or delete virtual records and accounts when reasonably needed to test, secure, repair, operate, or discontinue the service. We do not promise permanent preservation, future compatibility, or transfer into a later release.
6. Ownership, third-party materials, and feedback
Except for identified third-party materials, Trash Panda Software and its licensors retain all rights in Dungeons & Glory, including software, artwork, audio, text, characters, names, designs, and services. The Credits and Third-Party Notices identify applicable creators and licenses. Those third-party licenses govern their respective materials and are not reduced by these Terms.
If you voluntarily submit ideas, suggestions, bug reports, or other feedback, you grant Trash Panda Software a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, reproduce, modify, distribute, display, perform, and otherwise exploit that feedback for any purpose without compensation or attribution. This does not transfer ownership of personal information, which remains governed by the Privacy Policy.
7. Steam and purchases
Planned Steam distribution will be a one-time paid purchase unless the store page says otherwise. Steam transactions, downloads, and refunds are also governed by the Steam Subscriber Agreement, Steam Privacy Policy, and Steam Refund policy. Valve, not Trash Panda Software, processes Steam payment-card details. Nothing here limits a refund or consumer right that Steam or applicable law requires.
8. Suspension and termination
Trash Panda Software may investigate suspected violations and may warn, restrict, suspend, or permanently terminate access for cheating, exploiting, abusive usernames, harassment, fraud, attacks on the service, technical-control circumvention, unlawful activity, or other material violations. We may act immediately when reasonably needed to protect players, evidence, or the service.
You may appeal an enforcement decision through support@dungeonsandglory.com. Appeals are reviewed manually and do not guarantee reversal. You may stop using the service at any time and may request account deletion. On termination, the license ends; provisions that by their nature should survive continue, including ownership, feedback rights, disclaimers, liability limits, and dispute terms.
9. Availability and disclaimers
To the fullest extent permitted by law, the closed playtest, website, and services are provided as is and as available, with all faults. Trash Panda Software disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, security, and error-free operation. We do not promise that the playtest will launch publicly, remain available, preserve progress, or be compatible with future builds.
Some jurisdictions do not allow certain exclusions. These disclaimers apply only to the extent permitted, and they do not waive non-excludable consumer guarantees or remedies.
10. Assumption of risk and release
You download, install, access, and use this prerelease software at your own risk. To the fullest extent permitted by law, you knowingly assume the risks associated with doing so, including incompatible hardware or software, interruption, overheating or abnormal device operation, loss or corruption of local or account data and progression, and damage to a device or other property. Keep independent backups of important data and stop using the game if your device behaves unsafely.
To the fullest extent permitted by law, you release and hold harmless Trash Panda Software and its contributors, licensors, and service providers from claims for property damage, data or progression loss, interruption, or other losses caused by the risks you assume in this section. This assumption and release do not apply to any responsibility or remedy that applicable law does not allow you to waive or Trash Panda Software to exclude.
11. Limitation of liability
To the fullest extent permitted by law, Trash Panda Software and its contributors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, revenue, goodwill, data, progression, or use, arising from the game or services, even if advised of the possibility.
To the fullest extent permitted by law, their total aggregate monetary liability arising from the game or services is excluded entirely and will not exceed US $0. If applicable law does not permit complete exclusion, total aggregate monetary liability is limited to the minimum amount that law requires. Nothing in these Terms excludes or limits liability, refunds, consumer guarantees, or remedies that cannot lawfully be excluded or limited, including responsibility for fraud, willful misconduct, willful injury to a person or property, violation of law, gross negligence, or personal injury where applicable.
12. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Trash Panda Software and its contributors, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs, including attorneys' fees, arising from your unlawful or unauthorized use of the game or services, your material breach of these Terms, or feedback or other material you submit that infringes another person's rights.
You do not have to indemnify a protected party for that party's own fraud, willful misconduct, willful injury to a person or property, violation of law, or gross negligence, or to any other extent applicable law prohibits the obligation.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law or a non-waivable law of your residence applies. To the fullest extent permitted by law, any dispute must be brought exclusively in a state or federal court in California that has jurisdiction over Trash Panda Software, and each party consents to personal jurisdiction and venue there. Before filing a claim, you and Trash Panda Software agree to make a good-faith effort for 30 days to resolve it through the support address. These Terms do not require arbitration and do not waive any right to bring an eligible claim in small-claims court or any forum right that cannot lawfully be waived.
14. Changes and general terms
We may update these Terms as the playtest or law changes. The date at the top identifies the current version. If a change is material, we will provide reasonable notice appropriate to the service and ask for affirmative acceptance before treating the revised Terms as accepted. Passive continued use alone is not treated as acceptance.
If one provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms; Trash Panda Software may assign them with the project or business. These Terms, the Privacy Policy, applicable store terms, and identified third-party licenses are the entire agreement for the covered services.
